SCOPE OF THIS AGREEMENT

Under this agreement, wyshey.com offer products for sale, and the Customer buys remotely, exclusively via the Internet, the goods are described and offered for sale on the website www.wyshey.com.

Before placing any orders, you are supposed to read these General Terms and the pre-contractual information below very carefully and accept them.

The order confirmation email contains the link to the General Terms. wyshey.com recommend you should save and keep a copy of the General Terms, as provided by section 101 of the Indian Consumer Protection Act, 2019.

PRE-CONTRACTUAL INFORMATION FOR THE CONSUMER

Before entering into the purchase contract with us, you are requested to view the characteristics of the products offered for sale on the Site that is displayed on the single product pages accessible from every section.

Before the completion of the contract with the authorization to proceed to payment, wyshey.com make available to you on this Site or through this document the following information:

  • A summary of the main characteristics of each product ordered that are displayed on the single product pages already viewed by the Customer.
  • The total price of the purchased products including taxes, shipping costs, and every other cost.
  • The type of payment and delivery.
  • The terms and conditions for returning the purchased products.
  • The information is that you will have to pay the shipping costs for returning the purchased products in case you exercise the right to cancel.

HOW TO ENTER A CONTRACT WITH US.

The language offered for the conclusion of the contract is English.

When you decide to register, you must click on the “Sign in or register” link placed at the right-top corner of the Site and enter the requested data. The information will be used by us to manage your account.

Before proceeding, you are bound to read the General Terms. You are requested to accept, through a compulsory step, the General Terms by clicking on “Accept General Terms and Conditions of Online Sale”.

The products can be viewed and selected through the product pages published on our website.

The product is selected for purchase and added to the chart by clicking on the button “Add to Shopping Bag”.

At the top of each page, an icon indicating the number of products in the cart is always displayed.

Before submitting your order, it is always possible for you to check your order and correct any errors, remove items from the cart, and /or modify the quantity and the size of the products in the cart.

To proceed in the purchase process, you will have to click on the “Continue” button.

You can check the items in your cart by clicking on the “Checkout” button and then on “Continue”. You will access a new window where to enter your email address and password and then click on “Continue”. In case the shipping and/or billing information are different from those previously used, you can enter the new relevant data.

To proceed, you must click on the “Continue” button.

At this point, customers will access the final page that contains a list of the articles in the cart and the total price (including shipping costs).

Before proceeding, you are bound to read the General Terms and accept the General Terms, thus enabling payment and the execution of the order.

Therefore, before submitting the order and making the payment, you can check carefully the content of the cart and the purchase price of the items in the cart.

Without undue delay, wyshey.com will send an e-mail to the customer containing a summary of the ordered items and the ID order number.

The contract is considered completed when you receive a successive e-mail in which wyshey.com confirms that the order has been accepted and that the purchased items are being prepared for shipping (the “Order Confirmation E-mail”). The Order Confirmation E-mail contains a summary of all the elements of the contract:

  • The Customer’s data
  • The ID order number
  • The information relating to the main characteristics of the products purchased
  • The price of the products purchased, taxes, duties, shipping costs, and the type of payment
  • The address to which the purchased goods will be shipped
  • The link to the General Terms

wyshey.com reserves the right not to accept orders placed by a Customer who has previously broken the General terms, with whom there are pending legal cases or claims, who has abusively exercised the right to cancel, or who has carried out fraudulent activities. In the above cases, no contract shall be executed and wyshey.com shall inform you by e-mail that the contract has not been executed and that you will receive a full refund of the sum eventually paid.

Wyshey is an online retailer of apparel and lifestyle products offered at a great value to the consumer. Registration allows customers to purchase a variety of products. Upon placing an order, www.wyshey.com shall ship the product to the customers and be entitled to payment for the service.

PRODUCT AVAILABILITY

Wyshey.com ensures that through our IT system, the processing of orders and the dispatching of the purchased products are carried out without any undue delay. To this end, the availability of products displayed on the product page is updated in real-time.

However, due to the simultaneous presence on the Site of more users and the potentially high number of transactions taking place, the products displayed might be no longer available by the time you place your order.

Even after the Order Confirmation Email sent by wyshey, there might occur a total or partial unavailability of the products. In that case, you will be immediately informed by email of the unavailability of the ordered products and wyshey.com shall refund the full amount without undue delay. In this case, this contract shall be automatically terminated.

PRICING

Prices shown on the Site are determined by Wyshey.

Shipping costs, if any, are not included in the sale price but are displayed at checkout and are included in the total cost amount shown at the end of the purchase process and before authorizing payment. 

You hereby accept that Wyshey reserves the right to modify the prices at any moment. However, these changes will not affect orders that have already been dispatched. The price of an item includes GST (or similar sales tax) at the prevailing rate for which we are responsible as a seller. Please note that the prices listed on the website are only applicable for items purchased on the website and not through any other source. In any case, the purchased products will be charged based on the prices displayed on the Site when you placed your order and indicated on the order summary page.

In the case of errors that result in a substantial change in the sale price that makes it clearly excessive or significantly low, your order will be canceled and you will receive a full refund as soon as possible and, in any case, within sixty (60) days from the order’s cancellation.

PAYMENT

We at Wyshey strive to give you a streamlined checkout experience. However, in rare instances, things might go wrong while you are trying to place an order. Here are some frequently asked questions about payment-related issues – in case your query is not addressed here, you can mail us at support@Wyshey.com and our customer support team will get back to you as soon as possible.

Is it safe to make a Prepaid payment on Wyshey?

Yes, it is! While checking out, your actual payment transaction will be made with our partner Payment Gateways – Cashfree, CCAvenue, or PayU. These are well-established and secure payment gateways that are widely used by various businesses across India. Wyshey does not capture, process, or save any sensitive information.

How can I pay while checking out with a Prepaid order?

Our Payment Gateway partners accept UPI and all major Credit/Debit Cards (Visa, Mastercard, Rupay, American Express), Netbanking, and Wallet options.

What is the normal flow for a Prepaid order?

Once you are done with the transaction on the Payment gateway, you will reach the Thank You page on Wyshey confirming that your order was successful.

Additionally, you will also receive an e-mail with your order information and an SMS with a confirmation message. Your order will then be processed and dispatched from our office – you can read more details on our Delivery Information page.

There was an error while completing the payment and the amount is debited from my account/card. Help!?

Don’t worry! On rare occasions, transactions can fail because of network issues between the Payment Gateways and the banks or your card operators. This may also happen if the Payment Gateway is experiencing high volumes as well.

Your money is safe and will either reach us or be refunded back to you by your bank.

What happens if Wyshey does receive the payment after a transaction error?

Our customer team reconciles received payments and will manually process your order on the next working day. You will receive an order confirmation e-mail once this happens. 

In case you experience an error during your transaction – you can mail us at support@Wyshey.com and we’ll be happy to help you out. Again, your payment is safe, so don’t worry.

Should I place another order in case the first attempt at a payment fails?

Yes, you can. In case the first payment goes through as well, we can refund it back to you. You can mail us at support@Wyshey.com and we’ll be happy to help you out.

Do you accept payments over UPI?

Yes, we do – keep your VPA handy while checking out and you can make the payment using your preferred UPI app.

Are there any advantages of placing a Prepaid order instead of Cash on Delivery?

Yes! We offer Free Shipping across India for all Prepaid orders above Rs. 499. Cash on Delivery orders incur an additional COD handling fee that is charged by our courier partners – these charges are displayed during the checkout process before you confirm your order. 

In case of any Returns, Prepaid users have the option of receiving their funds back to their bank account/card/wallet whereas COD users will receive the amount only in the form of credits in their Wyshey Wallet.

We actively promote and encourage digital payments as they allow us to conduct business more efficiently.



wyshey.com accept the following payment methods:

  • Paypal;
  • Bank transfer;
  • Credit Card;
  • Cash on Delivery – CoD (where applicable).

If payment is made through Paypal, all costs shall be charged only after wyshey.com have sent the Order Confirmation E-Mail and the goods have been prepared for shipping. wyshey.com shall cancel your order if wyshey.com are unable to obtain payment authorization.

If you choose to pay via bank transfer, wyshey.com will communicate our bank details in the order confirmation e-mail. The ordered goods will be dispatched as soon as wyshey.com receive full payment for the order.

The Cash on Delivery service shall have an additional cost that will be displayed in the shopping cart. At the time of delivery, you will have to pay in cash the exact amount of the order. The courier shall not give change and shall not accept cheques. If you return an order paid with CoD, you will receive a refund by bank transfer. Please provide your bank data when requesting a return.

SHIPPING AND DELIVERY

DELIVERY INFORMATION

 

You will be given various options for the delivery of items during the order process. The options available to you will vary depending on where you are ordering from. An estimated delivery time is displayed on the order summary page. Upon placing your order, you will receive an email containing a summary of the order and also the estimated delivery time to your location. Sometimes, the delivery may take longer due to unforeseen circumstances. In such cases, we will proactively reach out to you by e-mail and SMS. However, we will not be able to compensate for any mental agony caused due to delay in delivery.

How long will it take for my order to arrive?

 

Once shipped out from our warehouse, deliveries usually happen within 5-7 working days depending on your location.

If your shipping address is in a remote area that is not easily accessible by regular courier companies, the delivery of your order may take a little longer.

In case of unforeseen circumstances such as strikes, natural disasters, acts of God, or intergalactic rioting, the delivery time may increase by a few days.

What if my order contains a Print on Demand (POD) product?

T-shirts are custom-made for you once you place an order. These products usually take 15-20 working days (excluding Sundays and bank holidays) to be manufactured and shipped out from our warehouse. If your order contains a mix of POD and stocked products, the entire order will be shipped together once your POD products are ready.

How do I track my order?

You will receive an e-mail with your courier tracking link once your order is shipped out from our warehouse. You can also find the tracking information on your Order History page.

Do check your e-mail spam folder in case you can’t find the e-mail from us.

Are there any shipping charges?

  • All Prepaid orders above Rs. 499 enjoy Free Shipping all over India!

  • Shipping charges of Rs. 60 will apply to all orders below Rs. 499.

 

What if a product is currently out of stock in the size I want?

We usually replenish our stock as soon as possible. You can leave your email address in the dialogue box that pops up when you try to add an item that’s out of stock to your cart to receive an email notification as soon as it’s back in stock.

Do you ship internationally?

Not at the moment.

Purchased products are delivered through a courier service at the address you provided. You are responsible for the address provided for the delivery of the purchased products. The address cannot be modified after the completion of the purchase contract.

Wyshey shall not be deemed liable for any agreement between you and the courier regarding a delivery address different from the one provided when finalizing the order and indicated in the order confirmation email.

Wyshey shall start the shipping process as soon as wyshey.com send the Order Confirmation E-Mail to you and shall deliver the purchased goods without undue delay and, in any case, within and no later than thirty (30) days from the day wyshey.com send the Order Confirmation E-Mail.

Once the courier has collected the purchased products, wyshey.com confirm shipping to you via e-mail and provides you with the indication of the courier used and the tracking number.

The delivery times provided by the courier and indicated in both the Orders and Delivery section of the Site and in the Shipping Confirmation E-Mail are indicative.

Delivery is considered fulfilled when the product is made physically available to you, or a third party specified by you, to the delivery address you specified on the order page. From the time the courier delivers the goods to the address you gave us, you take full responsibility for any loss or damage that may occur to your purchased goods for reasons not attributable to Wyshey.

The courier can utilize devices to gather electronic proof of delivery.

In case of missed delivery, the purchased product will be returned to Top Retailers, the contract shall be automatically terminated and Top Retailers shall refund the full amount paid by the customer and retain the cost of the unsuccessful delivery, the cost of returning the order to Top Retailers and custody fee.

Upon delivery, the customer is required to promptly verify the integrity of the package and the conditions of the product delivered.

Any damage to the product or packaging or non-correspondence of the products to those ordered must be immediately reported to the courier by writing ‘Unchecked’ on the proof of delivery.

If case of delivery problems or delays, you are advised to promptly contact Wyshey about this.

RIGHT TO CANCEL

 

Once the order is placed, the customer cannot cancel the order. Since we at Wyshey start the delivery preparation as soon as we get the order, canceling the order will waste the efforts done. 

EXCHANGES

1. Please note that the single products/combo products are not subject to return once the product is delivered. However, in case the product has an issue or defect in the material or print, you can submit a return request. For more visit the Return Policy

2. If a product (apparel) has any size issue once the shipment is delivered, then there will be no replacement or refund in any circumstances. So ensure your size concerning the given Size Chart before placing an order.

GUARANTEES AND CUSTOMER SUPPORT

  • The products offered for sale on wyshey.com are authentic.
  • The product pages on the Site contain a description of the essential characteristics of the products offered for sale.
  • Wyshey.com cannot guarantee that all descriptions are error-free and always accurate. Small differences between the descriptions on the Site and the actual product may also exist. wyshey.com undertakes to correct all errors in the shortest possible time since having been informed about them.
  • Moreover, the images of the products on the Site do not constitute a contractual element as they are for illustrative purposes only.
  • Wyshey shall be liable for any lack of conformity existing when the goods purchased on the Site are delivered that becomes apparent within two (2) months from the delivery of the goods.
  • You must notify us of any lack of conformity within two (2) weeks of discovering it.
  • In the event of lack of conformity, and following the notification of the lack of conformity, you shall be entitled to choose between repair and replacement of the product within a reasonable period unless the request is objectively impossible to satisfy or it is excessively expensive.
  • You must notify Wyshey of any lack of conformity via e-mail and you must attach to the e-mail all the suitable tax documents. Wyshey shall declare its availability to address the request or the reasons why it cannot be accepted within seven (7) days from the date of receipt of the e-mail.
  • In case Wyshey can execute the request, you shall be bound to follow the procedure for the return of purchased goods. After having received the purchased goods and verified the lack of conformity, Wyshey shall inform you of the time limit for the return of the repaired product or of the replacement or of the reasons why Wyshey cannot execute the request.
  • If the repair or the replacement of the product is impossible or excessively expensive, or if Wyshey has not repaired or replaced the product within the time limit above, or if the repair or the replacement previously carried out has caused you significant inconvenience, you shall be entitled to ask for a reasonable reduction of the price or the withdrawal from the contract about the goods object of the claim not more then the actual amount paid for the product by the customer after the discount.bIn that case, you will have to forward your request to Wyshey specifying the conditions for the total or partial refund of the amount previously paid.
  • Wyshey shall communicate the proposed reduction of the price or the conditions for the return of the faulty goods (if available to you) and then proceed to full or partial reimbursement.
  • Any conventional warranties for the products sold are provided directly from the manufacturer or retailer and their existence and duration are specified in the relevant product data sheets.
  • The amount of return and refund lies with Wyshey.


COMMUNICATION AND COMPLAINTS
All written communications to Wyshey and any complaints shall be considered valid if sent by mail to the following address: Support@wyshey.com.
In the registration form, you shall provide your residence or domicile details, your telephone number, and the e-mail address (which is a mandatory field) where you want to receive communications by TWyshey.

LIMITATION OF LIABILITY
Wyshey.com shall not be responsible for any non-performance due to an Act of God and/or unforeseeable circumstances, including those depending on the malfunctioning of the Internet network, if wyshey.com do not succeed in executing the contract within the time limit established in this contract.
Wyshey shall not be held liable for damages, losses, and costs incurred by you as a result of failure to execute the contract for reasons not attributable to us, and you shall only be entitled to a refund of the amount paid and any charges borne by you.
Wyshey.com is not responsible for any fraudulent and illegal use, made by third parties, of credit cards upon payment of the purchased products if wyshey.com prove that wyshey.com have taken all possible precautions by the best cutting-edge science and experience at that time and according to ordinary diligence.
The customer shall be held responsible for delays or mistakes in the payment if it’s proven that the customer has not made the payment in the times and manner specified by Wyshey.
